UPC Court Fees to Increase from January 2026

The Unified Patent Court (UPC) will implement a broad revision of its fee schedule with effect from 1 January 2026, raising core litigation costs and introducing new charges across several procedural areas.
Under the revised structure, core procedural fees for actions such as infringement, declarations of non-infringement and revocation will rise by around 33%. Value-based fees will also increase significantly by roughly 32% at first instance and about 45% on appeal, affecting higher-value disputes most visibly.
Certain applications will see particularly sharp adjustments. The fee for preservation of evidence and inspection orders will increase to €5,000 (previously €350), reflecting the UPC’s move to align charges more closely with the intensity and urgency of such measures. In addition, the Court will introduce new small fees for specific procedural requests, including enforcement steps and registry requests.
The changes accompany a tightened refund regime and the roll-out of value-based components for provisional measures and evidence measures, further integrating case value into overall cost exposure. Parties planning UPC litigation in early 2026 may wish to review timelines and budgets now, as the new fee schedule will apply to filings made on or after the effective date.
